Sublease Agreement

This Sublease Agreement (the “Sublease”) is entered into ___________________ by and between _______________________ (the “Sublessee”) and _________________________ (the “Sublessor”), also individually referred to as the “Party”, and collectively the “Parties”.


The Sublessor entered into a Lease Agreement dated __________ (the “Original Lease”) to lease space at a specific location; and

the Sublessor desires to lease that space to another party; and

the Sublessee desires to rent that space from Sublessor.


The Parties agree as follows:

  1. Premises. The property subject to this Sublease (the “Premises”) is located at:





  1. Term. The term of this Sublease is ___ months beginning on ________________ (the “Effective Date”).

  2. Costs & Payment.

    1. Rent: The rent is $___________ per month.  Rent payments are due on the ______ day of each month.  Rent payments may be made electronically or by mailing a check to:

The first rent payment is due on __________________.

  1. Utilities. In addition to paying rent, the Sublessee is also responsible for paying all utilities or other charges associated with the Premises.

  2. Deposit. The Sublessee will pay the Sublessor a deposit of $________ (the “Deposit”) prior to occupying the Premises to cover the cost of damages and cleaning.  If the Premises are returned in the same condition as they were when the Sublessee moved in, reasonable wear and tear excepted, the Sublessor will return the Deposit.  The Sublessor agrees to return the Deposit, or any remaining balance of the Deposit, within thirty (30) days of termination of the Sublease.

  1. Insurance. The Sublessee must carry renter’s insurance that meets the minimum standards required under the Sublessor’s Original Lease.

  2. Termination. The Sublease will automatically terminate on _________________.  The Sublessee must vacate the premises with all of Sublessee’s belongings by ____ AM/PM on __________________.

  3. Assignment. The Parties may not assign their rights and/or obligations under this Sublease unless both Parties agree to the assignment in writing.

  4. Dispute Resolution.

    1. Choice of Law. The Parties agree that this Sublease shall be governed by the State and/or Country in which the Premises are located.

    2. Negotiation. In the event of a dispute, the Parties agree to work towards a resolution through good faith negotiation.

    3. Mediation or Binding Arbitration. In the event that a dispute cannot be resolved through good faith negotiation, the Parties agree to submit to binding mediation or arbitration.

    4. Attorney’s Fees. In the event of Arbitration and/or Mediation, the prevailing party will be entitled to its legal fees, including, but not limited to, its attorneys’ fees.

  5. Entire Agreement. The Parties acknowledge and agree that this Sublease represents the entire agreement between the Parties. In the event the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both Parties.

  6. Severability. If any section of this Sublease is found to be invalid, illegal, or unenforceable, the rest of the Sublease will still stand.

  7. Attachments. The Original Lease is attached.  The terms of the Original Lease are incorporated into this Sublease.  The Sublessee agrees to assume the obligations and responsibilities of the Sublessor beginning on the Effective Date of this Sublease and continuing until the date of termination.

Landlord Approval

This Sublease is not valid until approved by the Sublessor’s landlord.  By signing below, the landlord consents to the subletting of the Premises based on the terms of this Sublease agreement.
